<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-47 <br /> <br />RESOLUTION DENYING THE APPLICATION OF EARLY LEARNING INSTITUTE, <br />AS FILED UNDER CASE PUD-96-19-lM <br /> <br />WHEREAS, Early Learning Institute has applied for a modification to an approved Planned Unit <br />Development for a private school to modify the conditions of approval to allow site <br />and building construction at 3800 Stoneridge Drive from 8:00 a.m. to 5:00 p.m., <br />Monday through Saturday; and <br /> <br />WHEREAS, zoning for the property PUD (Planned Unit Development) PII <br />(PubliclInstitutional) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of June 24, 1998, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff; and <br /> <br />WHEREAS, this modification is covered by the previous Negative Declaration prepared for the <br />original project; and <br /> <br />WHEREAS, the Planning Commission determined that the original commitment made by the <br />applicant to avoid Saturday construction activity was an important neighborhood <br />mitigation, which should be retained as a project requirement. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Denies the application of Early Learning Institute for a modification to an approved <br />Planned Unit Development for a private school to modify the conditions of approval <br />to allow site and building construction at 3800 Stoneridge Drive from 8 :00 a.m. to <br />5:00 p.m., Monday through Saturday. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption unless <br />appealed prior to that time. <br />
