<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-44 <br /> <br />RESOLUTION DENYING THE APPLICATION OF DIANE AND EDWARD CHURKA <br />(COFFEE ROAST EXPRESS), AS FILED UNDER CASE Z-98-145 <br /> <br />WHEREAS, Diane and Edward Churka (Coffee Roast Express) have applied for design review <br />approval to allow use of the second-floor attic space for an additional 2,450 square <br />feet of commercial office space in a building under construction located at 780 Main <br />Street and to meet the off-street parking requirements through an in-lieu agreement; <br />and <br /> <br />WHEREAS, zoning for the property is C-C (Central Commercial), Downtown Revitalization, <br />Core Area Overlay District; and <br /> <br />WHEREAS, at its duly noticed public hearing of June 24, 1998, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff; and <br /> <br />WHEREAS, this project is exempt from the requirements of the California Environmental <br />Quality Act (CEQA), because impacts of development were analyzed through the <br />Negative Declaration prepared for the original design review; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed use of the second-floor attic <br />space would negatively impact the current available parking and traffic. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section I. <br /> <br />Denies the application of Diane and Edward Churka (Coffee Roast Express for <br />design review approval to allow use of the second-floor attic space for an additional <br />2,450 square feet of commercial office space in a building under construction <br />located at 780 Main Street and to meet the off-street parking requirements through <br />an in-lieu agreement. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption unless <br />appealed prior to that time. <br />
