<br />PLANNlNG COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-43 <br /> <br />RESOLUTION APPROVING VESTING TENTATIVE TRACT MAP 7030, <br />THE APPLICATION OF DONG YU REAL ESTATE DEVELOPMENT <br /> <br />WHEREAS, Dong Yu Real Estate Development has applied for vesting tentative map <br />approval for a six-lot residential subdivision with the proposed lots <br />varying in size from approximately 26,500 square feet to 82,100 square <br />feet, located on the west side of Foothill Road at Equus Court; and <br /> <br />WHEREAS, zoning for the property is PUD - LDR/RDRlOS (Planned Unit <br />Development - Low Density ResidentialIRural Density Residential/Open <br />Space) District; and <br /> <br />WHEREAS, at its duly notice public hearing of June 10, 1998, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations ofthe City staff concerning this application; and <br /> <br />WHEREAS, a Negative Declaration of Environmental Significance was previously <br />adopted with the approval ofPUD-98-01, therefore, no additional <br />environmental document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />I. The proposed tentative map is consistent with the General Plan. <br /> <br />The proposed tentative map is consistent with the proposed PUD <br />development plan that was found by both the Planning Commission and <br />City Council to be consistent with the site's General Plan land use <br />designation and the current General Plan policies. The proposed homes <br />would be required to be sited in such a manner that the structure would <br />shield a portion of the rear outdoor yard area to provide noise levels <br />consistent with the General Plan's maximum acceptable level and avoid <br />the use of soundwalls and/or rearyard privacy fencing, pursuant to the <br />West Foothill Road Overlay District design policies. <br />
