<br />Resolution No. PC-98-40 <br />Page 2 <br /> <br />3. The design of the subdivision and proposed improvements will not cause <br />substantial environmental damage or substantially and avoidably injure <br />fish or wildlife or their habitat. <br /> <br />The subject site does not have any fish or wildlife resources. The tree <br />reports, which have been prepared for the site, show that the existing trees <br />are of little value and would be incompatible with residential <br />development. The proposed project would replace the existing dead or <br />dying trees on the site with new street trees that are more compatible with <br />residential development. <br /> <br />4. The design of the subdivision is not likely to cause serious public health <br />problems. <br /> <br />All improvements within the subdivision would be designed and built to <br />City standards for water, sewer, storm drainage, and access/circulation. <br /> <br />5. The design ofthe subdivision or its related improvements will not conflict <br />with easements, acquired by the public at large, for access through or use <br />of property within the proposed subdivision. <br /> <br />There are no easements over the subject site that will be negatively <br />impacted by the proposed development. <br /> <br />WHEREAS, the Planning Commission determined that the proposed tentative map is <br />consistent with the approved PUD development plan. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section I. <br /> <br />Approves Case Tract 7002, the application of Trumark Commercial for <br />vesting tentative map approval for a nine-lot residential subdivision with <br />the proposed lots varying in size from approximately 11,000 square feet to <br />12,400 square feet, located at 1605 and 1609 Rose Avenue, subject to the <br />conditions shown in Exhibit "B," attached hereto and made part of this <br />case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and <br />adoption unless appealed prior to that time. <br />
