Finding: Changes have been incorporated into the proposed Zone that would avoid <br /> the significant environmental effect as identified in the SEIR. Mitigation Measure <br /> (2012 SEIR)4.D-3, which has been incorporated into the proposed Zone,will <br /> reduce the significant environmental impact to a less-than-significant level. <br /> Facts in Support of Finding: The following facts and mitigation measure indicate <br /> that the impact will be reduced to less than significant. <br /> 1. Subsurface ground-disturbing activities within the area of the proposed Zone <br /> could have a significant impact on previously unknown unique paleontological <br /> resources. The City has a moderate sensitivity with regard to paleontological <br /> resources,and it is possible that paleontological resources could be present <br /> underground within the area of the proposed Zone. <br /> 2. Implementation of Mitigation Measure(2012 SEIR) 4.D-3 set forth in Table 6- <br /> 1 of the Final.SEIR and listed in the MMRP will ensure that Impact 4.E-2c <br /> would be reduced to a less-than-significant level and is hereby incorporated by <br /> reference and described below. <br /> (2012 SEIR) Mitigation Measure 4.D-3: In the event that paleontological resources <br /> are encountered during the course of development, all construction activity must <br /> temporarily cease in the affected area(s) until the uncovered fossils are properly <br /> assessed by a qualified paleontologist and subsequent recommendations for <br /> appropriate documentation and conservation are evaluated by the Lead Agency. <br /> Excavation or disturbance may continue in other areas of the site that are not <br /> reasonably suspected to overlie adjacent or additional paleontological resources. <br /> Site(s) affected: All sites within the proposed Zone. <br /> (Draft SEIR, pp. 4.E-17 to 4.E-19.) <br /> Impact 4.E-2d <br /> Development facilitated by the proposed Zone has the potential to disturb human <br /> remains, including those interred outside of formal cemeteries. <br /> The SEIR evaluates the impacts of the proposed Zone related to the disturbance of <br /> human remains. <br /> Significance Before Mitigation: Significant <br /> Significance After Mitigation: Less than Significant <br /> Finding: Changes have been incorporated into the proposed Zone that would avoid <br /> the significant environmental effect as identified in the SEIR. Mitigation Measure <br /> 4.E-6, which has been incorporated into the proposed Zone, will reduce the <br /> significant environmental impact to a less-than-significant level. <br /> 33 <br />
