<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-30 <br /> <br />RESOLUTION RECOMMENDING THE RESCISSION OF THE APPROVAL OF THE <br />DEVELOPMENT PLAN FOR CASE PUD-90-02 <br /> <br />WHEREAS, Case PUD-90-02, a planned unit development rezoning and development plan, <br />was approved by the City Council on June 19, 1990 for the development of four <br />new-single-family residences on the subject eastern parcel and retention of an <br />existing residence on the adjacent western parcel located at 445 Kottinger Drive; <br />and <br /> <br />WHEREAS, since the approval no subdivision map has been filed with the City, and <br />consequently, no building permits have been issued; and <br /> <br />WHEREAS, the development plan approved with PUD-90-02 does not conform to the City's <br />current standards for geotechnical "acceptable risk" or standards concerning <br />consistency with the character of surrounding site as expressed in the General <br />Plan; and <br /> <br />WHEREAS, at its duly notice public hearing of April 22, 1998, the Planning Commission <br />considered aU public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission determined that in order to protect the public health, <br />safety, and general welfare to the maximum extent feasible, it would be prudent, <br />for safety reasons, to rescind the approval of PUD-90-02. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section I. Recommends the rescission of the approval of Case PUD-90-02, a planned unit <br />development rezoning and development plan, for the development of four <br />new-single-family residences on the subject eastern parcel and retention of an existing <br />residence on the adjacent western parcel located at 445 Kottinger Drive. <br /> <br />Section 2. This resolution shall become effective immediately upon its passage and adoption. <br />
