<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-28 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF STANDARD PACIFIC OF <br />NORTHERN CALIFORNIA FOR A CONDITIONAL USE PERMIT, AS FILED <br />UNDER CASE UP-98-10 <br /> <br />WHEREAS, Standard Pacific of Northern California has applied for a conditional use permit <br />for a 480 square foot secondary unit to be constructed within a new two-story <br />home located at 1265 Pineto Place; and <br /> <br />WHEREAS, zoning for the property is PUD-AlOS/LDR (Planned Unit Development- <br />Agriculture/Open Space/Low Density Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of April 22, 1998, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The request to establish a secondary unit within the existing residence <br />conforms with the objectives and purposes of the zoning ordinance and the <br />purpose of the Ruby Hill PUD. State law considers secondary units as a <br />single-family use. The proposal would maintain the existing single-family <br />character of the Ruby Hill development because the unit is designed as <br />part of the home, indistinguishable from the exterior as a secondary unit. <br />A recommended condition of approval requires that either the primary <br />residence or the second unit be owner-occupied and that a maximum of <br />two adults shall be allowed to reside in the unit. This condition is required <br />to be recorded with the deed to the property. <br />
