<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-98-22 <br /> <br />RESOLUTION DENYING THE APPLICATION OF BHULABHAI AND VANITA <br />PATEL FOR A PUD MAJOR MODIFICATION AND APPROVING THE <br />APPLICATION FOR DESIGN REVIEW, AS FILED UNDER CASE PUD-90-19-7M <br /> <br />WHEREAS, Bhulabhai and Vanita Patel have applied for a major modification to a PUD <br />development plan (PUD-90-19) to allow a 456 square foot increase to the 4,500 <br />square foot maximum allowed house size, and design review approval for a 4,956 <br />square foot, two-story home with a 1,570 square foot, five-car garage located at <br />5568 Serenity Terrace (Lot 92 in the Moller Ranch project); and <br /> <br />WHEREAS, zoning for the property is PUD-LDRlRDR/OS (planned Unit Development - Low <br />Density ResidentialIRural Density ResidentiaVOpen Space) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of March 25, 1998, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA), therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission determined that the modification to the PUD <br />Development Plan to increase the maximum allowed house size is not appropriate; <br />and <br /> <br />WHEREAS, the Planning Commission determined that the proposed design review, with a <br />maximum size home of 4,500 square feet is appropriate for the site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Denies the application of Bhulabhai and Vanita Patel for a major modification to a <br />PUD development plan (PUD-90-19) to allow a 456 square foot increase to the <br />4,500 square foot maximum allowed house size for Lot 92 of the Moller Ranch <br />project (5568 Serenity Terrace). <br /> <br />Section 2. <br /> <br />Approves the application for design review approval for a 4,500 square foot, two- <br />story home located at 5568 Serenity Terrace (Lot 92 in the Moller Ranch project), <br />subject to the conditions shown in Exhibit "B," attached hereto and made part of <br />this case by reference. <br />
