PLANNING COMMISSION CITY OF PLEASANTON

ALAMEDA COUNTY, CALIFORNIA

RESOLUTION NO. PC-98-21

RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF DONG YU
REAL ESTATE DEVELOPMENT FOR PUD PLAN APPROVAL, AS FILED UNDER CASE
PUD-98-01

WHEREAS, Dong Yu Real Estate Development has applied for Planned Unit Development
(PUD) plan approval for a six-lot custom home development which revised the lot
layout and roadway configuration for this 7.68 acre portion of the property which
was formerly part of a 22-lot subdivision (Equus Heights) on approximately
50.36:,:: acres located on the west siJe of Foothill Road at Equus Court; and

WHEREAS, zoning for the property is PUD-LDR/RDRJOS (Planned Unit Development - Low
Density ResidentialIRural Density Residential/Open Space) District; and

WHEREAS, at its duly noticed public hearing of March 25, 1998, the Planning Commission,
after considering all public testimony, relevant exhibits, and recommendations of
the City staff, recommended approval of the proposed negative declaration
prepared for Case PUD-98-0 I; and

WHEREAS, the Planning Conunission made the following findings:

1. The plan is in the best interests of the public health, safety, and general
welfare.

The proposed project, as conditioned, meets all applicable City standards
concerning public health, safety, and welfare, e.g. vehicle access,
"acceptable risk" geologic hazards, and flood hazards. A geotechnical/
geological study has been prepared outlining necessary geotechnical
repairs that would be completed as part of the project improvements, as
well as identifying a minimum 50 ft. setback of habitable structures from
an earthquake fault zone. The proposed development generally meets the
intent of the West Foothill Road Corridor Overlay District ordinance and
guidelines which would ensure that the development blends with the rural
character of the area and preserve the views of the ridge. The project
would be required to complete improvements to its Foothill Road frontage
which will help improve the safety of vehicles, pedestrians, and bicycles
that use this road.
