PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-98-20 RESOLUTION RECOMMENDING APPROVAL OF A NEGATIVE DECLARATION FOR THE APPLICATION OF DONG YU REAL ESTATE DEVELOPMENT, AS FILED UNDER CASE PUD-98-01 WHEREAS, Dong Yu Real Estate Development has applied for PUD (Planned Unit Development) development approval for a six-lot custom home development, which revises the lot layout and roadway configuration for this 7.68 acre portion of the property which was formerly part of a 22-lot subdivision on approximately 50.36:1: acres located on the west side of Foothill Road at Equus Court; and WHEREAS, zoning for the property is PUD-LDR/RDR/OS (Planned Unit Development - Low Density ResidentiaIlRural Density ResidentiaIlOpen Space) District; and WHEREAS, an Environmental Impact Report was prepared and certified for the previously- approved Planned Unit Development rezoning and development plan approval, and based on the requirements of the California Environmental Quality Act (CEQA) the proposed modification to the development plan is within the scope of the EIR and that a negative declaration must be adopted evaluating the proposed changes; and WHEREAS, the Planning Commission has received and reviewed the Initial Study January 15, 1998, and received the recommendations of staff; and WHEREAS, at its meeting of March 25, 1998, the Planning Commission received a proposed negative declaration prepared for Case PUD-98-0l; and WHEREAS, a duIy noticed public hearing was held at which time the public was given the opportunity to comment on the environmental impacts of the proposal; and WHEREAS, the Planning Commission has reviewed the potential impacts in accordance with the applicable state and local guidelines governing the preparation of Negative Declarations and Environmental Impact Reports; and WHEREAS, the Planning Commission fmds that approval of the proposed project wouId not have any significant adverse effects on the environment.
