November 7, 2017 City Manager's Office TITLE: ACCEPT KOTTINGER VILLAGE COMMUNITY PARK IMPROVEMENTS BY MIDPEN HOUSING CORPORATION AND L&D CONSTRUCTION PURSUANT TO CALIFORNIA HOUSING-RELATED PROGRAM GRANT AND APPROVE ASSIGNMENT & ASSUMPTION AGREEMENT SUMMARY In 2016, the City was awarded a $330,900 California Housing-Related Parks Program Grant for pathway and landscaping improvements to Kottinger Village Community Park in conjunction with the Kottinger Gardens senior housing rehabilitation project. The City and MidPen Housing Corporation executed an Agreement for Park Improvements in December of 2016 that provided that MidPen's general contractor, L&D Construction, would build the park improvements in coordination with the larger housing project. That agreement stated that when the park improvements were completed, the parties would enter into an Assignment &Assumption Agreement with Consent, whereby MidPen and L&D Construction agree that work is done and all payments made, and then the City receives a maintenance bond and warranty rights. The park improvements have now been completed, and are ready for Council acceptance. RECOMMENDATION 1. Accept the park improvements as complete. 2. Authorize the City Clerk to file a Notice of Completion for the park improvements. 3. Authorize the City Manager to execute the Assignment &Assumption Agreement with Consent. FINANCIAL STATEMENT Funding for this project totals $330,900 and is paid from the California Housing-Related Parks Program Grant.
