ATTACHMENT 4 <br />ORDINANCE NO. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />APPROVING A PLANNED UNIT DEVELOPMENT (PUD) REZONING FOR <br />THE APPLICATION OF THE CITY OF PLEASANTON FOR <br />THE JOHNSON DRIVE ECONOMIC DEVELOPMENT ZONE (JDEDZ) <br />AS FILED UNDER CASE PUD -105 <br />WHEREAS, The City of Pleasanton has applied for a Planned Unit Development <br />(PUD) Rezoning to rezone 12 parcels at 7106 through 7315 Johnson Drive and 7035 <br />and 7080 Commerce Circle, comprising approximately 40 acres known as the Johnson <br />Drive Economic Development Zone, from Planned Unit Development -General and Light <br />Industrial (PUD-G&LI) District, Planned Unit Development-Industrial/Commercial-Office <br />(PUD-I/C-O) District, and General Industrial (I -G-40,000) District to PUD -C (the <br />"Project"); and <br />WHEREAS, at its duly noticed public meeting of October 11, 2017, the Planning <br />Commission considered all public testimony, agenda reports, relevant exhibits, and <br />recommendations of the City staff concerning the proposed PUD Rezoning; and <br />WHEREAS, the Planning Commission at its regular meeting on October 11, <br />2017 adopted Resolution No. PC -2017-21, determining that the proposed Rezoning is <br />appropriate for the Project and recommending to the City Council that PUD -105 be <br />approved; and <br />WHEREAS, at its duly noticed public meeting of November 7, 2017, the City <br />Council considered all public testimony, agenda reports, relevant exhibits, and <br />recommendations of the City staff concerning the proposed PUD Rezoning; and <br />WHEREAS, the City Council finds that the proposed PUD Rezoning is consistent <br />with the City's General Plan and purposes of the PUD Ordinance as set forth in the <br />agenda report and pursuant to the California Environmental Quality Act (CEQA), a <br />Supplemental Environmental Impact Report (SEIR) was prepared and certified for the <br />Project. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />DOES HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Approves Case PUD -105, the application for a Planned Unit <br />Development (PUD) Rezoning to rezone 12 parcels at 7106 through 7315 Johnson <br />Drive and 7035 and 7080 Commerce Circle, comprising approximately 40 acres known <br />as the Johnson Drive Economic Development Zone, from Planned Unit Development - <br />General and Light Industrial (PUD-G&LI) District, Planned Unit <br />Development-Industrial/Commercial-Office (PUD-I/C-O) District, and General Industrial <br />(I -G-40,000) District to PUD -C, subject to the conditions as shown in Exhibit A, the Draft <br />Development Standards and Design Guidelines dated March 2017 as shown in Exhibit <br />
