BACKGROUND <br />On August 24, 2016, the Planning Commission recommended City Council approve <br />applications by Catalyst Development Partners, LLC for a development project <br />proposed on three contiguous Tots: 536 and 550 St. John Street and the vacant, non - <br />addressed lot east of 536 St. John Street (APN 94-122-19). The applications were for: <br />• Rezoning approval of the three lots. <br />• Planned Unit Development (PUD -120) approval to retain and relocate the <br />existing historic single-family home on the project site and construct 10 two-story <br />townhomes and associated site improvements. <br />• Vesting Tentative Map approval to subdivide the three lots into 11 residential lots <br />and one common lot. <br />On October 4, 2016, the City Council approved the: <br />• Rezoning of 536 and 550 St. John Street and the vacant lot east of 550 St. John <br />Street. <br />• PUD -120 and adopted Ordinance No. 2151. <br />• Vesting Tentative Map and adopted Resolution No. 16-16885. <br />In November of 2016, KN St. John LP purchased the site from Catalyst Development <br />Partners, LLC. <br />The developer has submitted the required agreements, Final Map, Improvement Plans, <br />and other legal documents for Tract 8326. Engineering and Planning staff and the City <br />Attorney's Office have reviewed these documents and have found them to be in <br />substantial compliance with the approved PUD -120 and Vesting Tentative Map. <br />Additionally, the developer has paid development fees and submitted security bonds <br />(performance and labor and material bonds) as provided for in the subdivision <br />agreement. <br />DISCUSSION <br />Proposed Improvements and Maintenance Responsibility <br />As shown on Attachment 2, the development proposes a new private street (Wise Way). <br />The private street, bio-swales for stormwater treatment, and private utilities (including <br />storm drain systems within the private street) will be maintained by a homeowners <br />association specifically created for this development. <br />The development proposes to construct a public sanitary sewer main within the private <br />street (in a dedicated public easement) to serve the 11 single-family home Tots. The <br />sanitary sewer main will be owned and maintained by the City. <br />Additionally, the development proposes to install separate water meters and service <br />laterals to serve all 11 lots. The water meters will be installed within the existing public <br />right of way on St. John Street. The service laterals serving Lots 1-6 will be located <br />within the new private street and in a private utility easement; the service laterals <br />serving Lots 7-11 will be located within the respective lots. <br />Page 2 of 3 <br />
