Attachment 1 <br />FOURTH AMENDMENT TO EMPLOYMENT CONTRACT <br />This Fourth Amendment to Employment Contract (Fourth Amendment) is entered <br />into November <br />Nelson Fialho. <br />, 2017, between the City of Pleasanton, a municipal corporation, and <br />Recitals <br />WHEREAS, Nelson Fialho has served as Pleasanton's City Manager since 2004 <br />pursuant to the Employment Contact City Manager dated October 13, 2004, as amended <br />by the First Amendment dated December 4, 2007, the Second Amendment dated January <br />4, 2011, and the Third Amendment dated July 22, 2015 (collectively the Contract); and <br />WHEREAS, the Mayor and Council have reviewed City Manager Nelson Fialho's <br />performance, noted accomplishment of many City Council Work Plan Priorities, and <br />considered his compensation in light of a salary survey. <br />NOW, THEREFORE, in consideration of the mutual promises expressed in this <br />Fourth Amendment, the parties agree as follows: <br />A. Section 3. Compensation of the Contract is amended to provide that the annual <br />salary shall be increased by 5% to $228,082 effective September 9, 2017. Also beginning <br />September 9, 2017, the annual contribution into his deferred compensation account shall <br />be increased by 2.5% to 4.5% of his salary. Nelson will also be paid $7,500 upon <br />completion of an accredited Continuing Executive Education Training Program. <br />B. Section 4. Benefits is amended to provide: <br />The City will contribute a monthly amount for medical insurance coverage for <br />Nelson no greater than the lowest cost HMO family rate offered. During the term <br />of this Contract, the City shall offer Kaiser as a health plan option. <br />Effective January 1, 2018, Nelson will contribute one of the following two amounts, <br />whichever is greater: <br />1. $50.00 per month; or <br />2. The difference between the family rate of the lowest cost HMO and the <br />premium of Nelson's more expensive plan selection. <br />Contributions will be deducted from Nelson's paycheck on a pre-tax and bi-weekly <br />basis. <br />C. Except as amended by this Fourth Amendment, all other terms and conditions of <br />the Contract shall remain in full force and effect. <br />
