days for employees working Friday through Sunday. Transition to, and continuation of, this <br /> schedule is dependent upon acceptable staffing levels as determined by the Police Chief at the <br /> time of transition. " <br /> The Department desires to balance the employee's needs with the Department's need for <br /> flexibility and discretion in assigning personnel to meet operational staffing levels. While <br /> balance is desirable, the paramount concern is the need to meet operational requirements of the <br /> Department. Nothing included in this section is meant to reduce or infringe upon the City's <br /> rights as identified in Section 6 of the MOU between the PPOA and the City. <br /> Both the Police Chief and the PPOA have the right to discontinue the TBHS based on identified <br /> concerns. Notice to discontinue the TBHS shall be given to the other party in written form 45- <br /> days prior to the beginning of a shift cycle. <br /> 1. WORK PERIODS, CYCLES AND HOURS <br /> a. Definitions: <br /> • Notwithstanding the overtime standard established in Section 2 of this Side <br /> Letter, the City declares,pursuant to the Fair Labor Standards Act, 29 U.S.C. <br /> section 207(k), a regularly occurring work period comprised of twenty-eight <br /> (28) consecutive days, to begin on January 4, 2014. Each calendar year will <br /> consist of thirteen (13) work periods. <br /> • A cycle is a grouping of four(4) or five (5) work periods: January—May (4 <br /> work periods), May—September(5 work periods) and September—January (4 <br /> work periods) <br /> b. Employees are expected to work 160 work hours during each 28-day work period. <br /> • Employees who work Schedule A will meet this requirement during each <br /> work period. <br /> • Employees who work the Schedule B will have worked 150 hours during <br /> each work period. Therefore, they are required to work an additional <br /> thirteen(13) 10-hour days each year; one per 28-day work period. <br /> c. Four(4) of the 10-hour days are required training days. The Department will <br /> designate the specific work periods and dates for the training. <br /> The remaining nine (9) 10-hour days for the year are designated as relief days. On <br /> these relief days, employees shall 1)provide relief coverage for training,2) attend <br /> discretionary training programs, or 3)take part in operational or other activities as <br /> designated by the Department. <br /> d. The start and end times of work shifts will remain a management prerogative. Once <br /> established,they may be changed after notice to the Association and upon request, <br /> meeting and conferring with the Association regarding the impact of the change in <br /> hours. <br /> 2. OVERTIME <br /> a. Overtime must be approved in advance by the Chief of Police or his or her designee. <br /> 30 <br />
