(d) That unobstructed flow of high quality <br /> <br /> water is necessary to maximize the beneficial <br /> use of water by the inhabitants of the City <br /> of Pleasanton. <br /> <br /> (e) That the depositing of foreign materials within <br /> watercourses herein create unsightly con- <br /> ditions or conditions otherwise offensive to <br /> the senses which have thereby an adverse effect <br /> upon the value of surrounding properties or tend <br /> to attract children and/or derelicts and invite <br /> the destruction of property, or tend to attract <br /> rodents or other animals dangerous to the public <br /> health and safety. <br /> <br />4-7.02 Declaration of Policy. It is hereby declared to be <br /> in the interest of the public health, safety, and <br /> welfare that watercourses located within the City of <br /> Pleasanton and not under ownership of the Alameda <br /> County Flood Control and Water Conservation District <br /> be maintained free of obstructions and materials which <br /> contribute to the degradation of water quality or which <br /> are unsightly or otherwise offensive to the senses or <br /> which tend to attract children, derelicts, rodents or <br /> other animals; that the owners of property through whic~ <br /> said watercourses flow are primarily responsible for <br /> maintaining a free flow of water through said property <br /> and for maintaining the quality of water as said water <br /> passes to downstream users; that the City of Pleasanton <br /> shall assume responsibility for abatement of water- <br /> course obstruction or materials within watercourses <br /> which contribute to the degradation of water quality <br /> or which are unsightly or otherwise offensive to the <br /> senses within the City of Pleasanton in the absence of <br /> exercise by owners of such primary responsibility, <br /> through commencement and prosecution of abatement <br /> <br /> proceedings as provided herein. <br /> -3 - <br /> <br /> <br />
