ATTACHMENT I ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING MUNICIPAL CODE CHAPTERS 14.04 AND 14.08 TO INCORPORATE THE WATER SUBMETER REQUIREMENT FOR MULTIUNIT STRUCTURES FROM SENATE BILL 7 WHEREAS, the California legislature has found that water conservation is more effective when individuals can track their own water usage and makes this possible through a requirement that each dwelling in a multiunit residential structure of two or more dwelling units have an individual water meter or submeter as required by Senate Bill 7 (2016, Wolk); and WHEREAS, amendments are needed to the municipal code to incorporate the submetering requirements of SB 7. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Finds that changes to the Municipal Code incorporating submetering requirements for multiunit residential structures as required by SB 7 have no possibility to have a significant effect on the environment per Title 14 California Code of Regulations §15061(b)(3). Section 2. Adopts amendments to Municipal Code Chapters 14.04 Regulation of Water System and Water Service Fees and 14.08 Water Connections as shown in the attached Exhibit A. Section 3. Finds that consistent with Municipal Code§ 14.04.050.6 and the new California Water Code § 537 1(a), for purposes of determining the applicability of SB 7, "an application for a water connection" shall be the earlier of the date when a person first submits for a building permit or for an encroachment permit for a multiunit residential structure. Section 4. A summary of this ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times", a newspaper of general circulation published in the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its adoption.
