Exhibit "C', Draft Conditions of Approval for <br /> PCUP-89 <br /> <br />September 2, 2003 <br /> <br />Approval of this conditional use permit shall be contingent upon approval of the PUD <br />development plan modification, Case PUD-93-02-5M. <br /> <br />The event center shall be operated in conformance to the statements of operation de- <br />scribed in the letter from Michael Callahan of Callahan Properties, dated April 29, 2003, <br />and the letter from Read Phillips of Beets Catering, dated Febma~ 24, 2003, on file with <br />the Planning Depa~huent, except as modified by the following conditions. Minor <br />changes may be allowed subject to the approval of the Planning Director if found to be in <br />substantial conformance to the approved exhibits. <br /> <br />Weddings and similar types of ceremonies are allowed to take place in the patio area by <br />the east side of the event center. During these ceremonies, there may be acoustical-only <br />performers. Outdoor activities shall cease by 9:00 p.m. All other events/performances <br />shall take place inside the event center only, and shall conclude by 11:00 p.m. During the <br />event/performance, the windows and entrance/exit doors on the building sides facing the <br />Ruby Hill homes shall remain closed, but not locked, at all times. <br /> <br />For large events/performances taking place at the event center/barrel storage building, <br />which would exceed the parking capacity of the main parking lots adjacent to the winery <br />building, the owner/operator shall provide valet parking and two valet stations located on <br />the east and west sides of the main winery building. If necessary, the project developer <br />may configure the driveway aisles in these locations to a one-way direction enabling <br />these valet stations to handle two or more parallel rows of waiting cars. At no time may <br />guests be allowed to queue onto Vineyard Avenue. <br /> <br />If guest traffic to/from the event center leads to congestion on Vineyard Avenue, the City <br />has the discretion to require the project developer post temporary traffic control personnel <br />to direct traffic. The costs associated with the traffic control personnel shall be paid for <br />by the project developer. <br /> <br />At no time shall balloons, banners, pennants, search lights, or other attention-getting de- <br />vices be utilized on the site. This prohibition would not apply to the building and palm <br />tree up-lighting. <br /> <br />In the event that nuisances are created through the operation of the event center, either <br />within the event center itself or by its patrons in its vicinity, including DUI violations, the <br />Planning Director may refer the conditional use permit to the Planning Commission for <br /> <br />PCUP-89, Final CC Conditions Page 1 of 2 September 2, 2003 <br /> <br /> <br />
