EXHIBIT "B" <br />Conditions of Approval <br /> PUD-17 <br /> 8272 Sassafras Court <br /> September 2, 2003 <br /> <br />Planning <br /> <br />1. The proposed development shall conform substantially to the development plan and design <br /> guidelines/development standards Exhibit A, dated "Received May 6, 2003", on file with the <br /> Planning Depatianent, except as modified by these conditions. Minor changes to the plans <br /> may be allowed subject to the approval of the Planning Director if found to be in substantial <br /> conformance with the approved exhibits. <br /> <br />The development plan shall be of no further validity and the project developer shall be <br />required to submit the same or new development plan for City approval prior to development <br />of the site in the event that the project developer fails to record a final parcel map within two <br />(2) years of PUD approval. <br /> <br />3. The project shall be subject to all uses, development standards, and other related <br /> requirements of PUD-89-17 and Vesting Tentative Tract Map 6563, except as specifically <br /> modified by this approval. <br /> <br />4. The northwest lot line of Parcel 3 shall be revised to follow the toe of the adjacent recent <br /> landslide as shown on" Exhibit - Staffprepared Modified Setback Area". The PUD <br /> development plan site plan shall be modified to reflect this lot line revision and marked with <br /> the landslide outlines and modified landslide setbacks. This modified site plan shall be <br /> submitted for the review and approval of the City's geotechnical peer reviewer. All costs <br /> associated with this peer review shall be paid for by the developer prior to approval of the <br /> minor subdivision. <br /> <br />5. The PUD development plan shall be revised to show the revised building envelope/setbacks <br /> per this approval prior to the approval of the minor subdivision. <br /> <br />6. The design guidelines shall be modified to include the prohibition of the use of second-story <br /> windows in the front of the future residence on proposed Parcel 1 that would allow views <br /> from inside the house to the future home at 8243 Foundry Court.
