ATTACHMENT #1 RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING RESOLUTION NO. 15-796 AND THE MASTER FEE SCHEDULE (RESOLUTION NO. 92-100) TO REDUCE SEWER RATES FOR RUBY HILL PROJECT AREA CUSTOMERS BY TEN PERCENT (10%) FOR THE REMAINING DURATION OF THE AGREEMENT FOR WASTEWATER AND DISPOSAL SERVICES WITH THE CITY OF LIVERMORE, AND AN AMENDMENT TO THAT AGREEMENT WHEREAS, on October 6, 2015, the City Council adopted Resolution No. 15-796 amending the Master Fee Schedule (Resolution No. 92-100) to revise sewer rates and charges; and WHEREAS, the City Council desires to amend Resolution No. 15-796 and the Master Fee Schedule (Res. 92-100) to reduce residential and commercial sewer rates (user charges — bimonthly) by implementing a ten percent (10%) reduction to the Local Charge and Regional — Livermore charge; and WHEREAS, sewer rates and charges in Ruby Hill are subject to the Agreement for Wastewater and Disposal Services entered into in 1993 with the City of Livermore, and the City of Livermore and the City of Pleasanton seek to amend the agreement to reflect the City of Livermore's and City of Pleasanton's reduction in charges for the Ruby Hill Area, which reductions will be in effect from January 1, 2018 through the end of the term of the agreement on September 13, 2023. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Resolution No. 15-796 and the Master Fee Schedule (Res. 92-100) are amended to reduce the sewer rates (user charges — bimonthly) for residential and commercial customers in the Ruby Hill project area by implementing a ten percent (10%) reduction to the Local Charge, and a 10% reduction in the Regional-Livermore charge as follows: A. Sewer Rates & Charges User Charges—Bimonthly Residential (rate per dwelling unit): Local Charge Regional- Total Total Livermore Single-Family - Ruby Hill $22.67 $86.71 $109.38 For a customer whose bimonthly billing cycle begins before January 1, 2018 but ends after the commencement of the 10% reduction, that customer shall receive a 10% discount pro-rated based on the number of days in the bimonthly billing cycle when the discount was in effect. Similarly, for a customer whose bimonthly billing cycle begins before September 13, 2023 but ends after the expiration of the 10% reduction, that customer shall receive a 10% discount pro- rated based on the number of days in the bimonthly billing cycle when the discount was in effect.
