Ord.2164 <br /> Page 13 <br /> housing to implement 100% smoke-free housing policies in multi-family housing to <br /> reduce the exposure of residents to secondhand smoke; and <br /> WHEREAS, a local ordinance that requires multifamily rental apartment lease <br /> agreements to include a prohibition on smoking of tobacco products within rental <br /> units is not prohibited by California law; and <br /> WHEREAS, local governments have broad latitude to protect the public <br /> health; and <br /> WHEREAS, there are other types of local regulations in Pleasanton that restrict <br /> individuals from engaging in certain activities at their residences even though the same <br /> activity may be permissible at other locations within the City, including, for example, <br /> noise level regulations, fire regulations and limitations on running certain types of <br /> businesses from a residence; and <br /> WHEREAS, this ordinance is adopted: (1) to protect the public health, safety, <br /> and welfare of lawful occupants of multifamily rental apartments by discouraging <br /> smoking around non-smokers and decreasing the nonconsensual exposure of <br /> secondhand smoke to the public in and around their residences; and (2) to strike a <br /> reasonable balance between the needs of persons who smoke and the needs of <br /> nonsmokers to breathe smoke-free air, and to recognize that the need to breathe <br /> smoke-free air has priority. <br /> // <br />
