RESOLUTION NO. 17-966 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ESTABLISHING AN INTERIM CITY POLICY TO NOT ACCEPT APPLICATIONS FOR <br /> WATER AND/OR SEWER SERVICE CONNECTIONS IN THE REMEN TRACT, WITH <br /> EXCEPTIONS FOR A HEALTH AND SAFETY EMERGENCY <br /> WHEREAS, the unincorporated Remen Tract is an approximately 22-acre area of <br /> unincorporated Alameda County that is surrounded by the City where some of the 48 existing <br /> parcels are served by City water and sewer service based on previous City-approved <br /> preannexation agreements, and where the water and sewer mains were privately constructed and <br /> often located in private easements; and <br /> WHEREAS, at the July 13, 2017 meeting of the Alameda County Local Agency Formation <br /> Commission (LAFCo) for the consideration of retroactive approval of 19 out-of-area service <br /> agreements to provide City water and sewer services to parcels within the unincorporated Remen <br /> Tract, the LAFCo board conditioned its approval on the preparation of an infrastructure study in <br /> the Remen Tract, including a plan to provide services that outlines the current nature and extent <br /> of municipal services and related infrastructure as they are provided by the City, Alameda County, <br /> and other applicable agencies, and an analysis of proposed changes in service and/or service <br /> levels that would be required by the City if the Remen Tract were to be annexed, as well as <br /> financing options for any needed improvements; and <br /> WHEREAS, the completion of such an infrastructure study in the unincorporated Remen <br /> Tract is prudent before any further development occurs, and therefore an interim policy to not <br /> accept applications for water and/or sewer service connections in the Remen Tract is appropriate <br /> until the study is completed and accepted. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Finds that this interim policy is exempt from any requirements of the <br /> California Environmental Quality Act as provided in Title 14 California Code of Regulations <br /> §15262 as it relates to a feasibility and planning study for Remen Tract utilities, and §15061(b)(3) <br /> as the interim policy to not accept applications for development has no possibility of having a <br /> significant effect on the environment. <br /> SECTION 2. Directs staff to not accept applications for water and/or sewer service <br /> connections for properties within the unincorporated Remen Tract until such time the policy is <br /> rescinded by City Council. Exceptions to this interim policy include cases of an emergency as <br /> determined by the Director of Community Development or the Director of Engineering, LAFCo's <br /> policies and state law regarding an "existing or pending public health and safety threat" pursuant <br /> to California Government Code §56133(c). <br /> SECTION 3. This resolution shall be effective immediately upon its passage and <br /> adoption. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on September 5, 2017. <br />
