THE CITY OF <br /> 15b <br /> ®' -• °° '°°' CITY COUNCIL AGENDA REPORT <br /> pL•EASANTON® <br /> September 5, 2017 <br /> City Attorney <br /> TITLE: CONSIDER AMENDMENT TO FOUR MAINTENANCE AGREEMENTS <br /> BETWEEN THE CITY AND THE HACIENDA BUSINESS PARK <br /> OWNERS ASSOCATION TO EXTEND THE TERMS OF THOSE <br /> AGREEMENTS AND TO ALLOW THE CITY TO SHARE LEASE <br /> REVENUE FROM SMALL-CELL-WIRELESS SYSTEMS LOCATED IN <br /> STREET LIGHTS IN THE HACIENDA BUSINESS PARK <br /> SUMMARY <br /> The City Council is being asked to approve amendments to four maintenance <br /> agreements between the City of Pleasanton and the Hacienda Business Park Owners <br /> Association. These four agreements were entered into in the 1980s and they dictate <br /> the maintenance responsibilities for certain infrastructure located in the Hacienda <br /> Business Park and within the City-right-of-way. The Amendment (see Attachment A for <br /> proposed Amendment) will extend the term of the four maintenance agreements and <br /> will allow the City and Hacienda to share the lease revenue generated from wireless <br /> carriers being able to lease the interior of the streetlight poles for small-cell-wireless <br /> systems. <br /> RECOMMENDATION <br /> Staff recommends that the City Council approve the "Amendment to Four Maintenance <br /> Agreements between Hacienda Business Park Owners Association and the City of <br /> Pleasanton." (See Attachment 1 for proposed Amendment.) <br /> FINANCIAL STATEMENT <br /> The Amendment will provide additional revenue to the City. As streetlight poles are <br /> removed and replaced with "smart poles" the City and Hacienda will share the revenue <br /> from the leasing of the interior of the poles for small-cell-wireless systems. More <br /> specifically, the City will receive $100 per month per smart pole that is installed within <br /> the right-of-way in the Hacienda Business Park. <br />
