12 <br /> ORDINANCE NO. 2167 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING MUNICIPAL CODE § 14.04.140 TO ALLOW THE CITY MANAGER TO <br /> APPROVE AN ADMINISTRATIVE POLICY TO CREDIT UTILITY BILLS AFTER <br /> CERTAIN WATER LEAKS ARE REPAIRED <br /> WHEREAS,the Municipal Code directs customers to repair a water leak within eight hours <br /> of becoming aware of such a leak; and <br /> WHEREAS, after a water leak is repaired, some customers ask for a credit on their water <br /> bill; and <br /> WHEREAS, the City has historically considered such credits after unexpected or hard-to- <br /> detect water leaks are repaired, and the Municipal Code is proposed to be amended to authorize <br /> the City Manager to adopt an administrative policy to address utility bill credits under certain water <br /> leak repair situations. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Finds that the amendment to the Municipal Code allowing for an <br /> administrative policy for credits to utility bills after certain water leaks are repaired is exempt from <br /> the California Environmental Quality Act (CEQA) as there is no possibility that any such adopted <br /> policy may have a significant effect on the environment per Title 14 California Code of Regulations <br /> § 15061(b)(3). <br /> SECTION 2. Subsection B of § 14.04.040 the Pleasanton Municipal Code is amended <br /> as follows: <br /> B. Adjustment of Bills for Meter Error or Leaks. <br /> 1. Fast Meters. When, upon test, the average meter error is found to <br /> be more than two percent fast, the city will refund to the consumer the <br /> amount of the overcharge based on corrected meter readings for the <br /> period the meter was in use but not exceeding six months. <br /> 2. Slow Meters. When, upon test, a meter is found to be registering <br /> more than five percent slow, the city may bill the consumer for the <br /> amount of the undercharge based upon corrected meter readings for <br /> the period the meter was in service but not exceeding six months. <br /> 3. Nonregistering Meters. The city may bill the consumer for water <br /> consumed while the meter was nonregistering but for a period not <br /> exceeding six months at the minimum monthly meter rate, or upon an <br /> estimate of the consumption based upon the consumer's prior use <br /> during the same season of the year if conditions were unchanged, or <br /> upon an estimate based upon a reasonable comparison with the use <br /> of other consumers during the same period, receiving the same class <br /> of service under similar circumstances and conditions. <br />
