THE CITY OF ��•• 9_ _ <br /> f �;i Bit f ni∎IL <br /> LEAS4NTONC CITY COUNCIL AGENDA REPORT <br /> September 5, 2017 <br /> Community Development <br /> Engineering <br /> TITLE: ADOPT A RESOLUTION ESTABLISHING AN INTERIM CITY POLICY TO <br /> NOT ACCEPT APPLICATIONS FOR WATER AND/OR SEWER SERVICE <br /> CONNECTIONS IN THE UNINCORPORATED REMEN TRACT, EXCEPT <br /> FOR A HEALTH AND SAFETY EMERGENCY, UNTIL COMPLETION OF <br /> AN INFRASTRUCTURE STUDY <br /> SUMMARY <br /> Alameda Local Agency Formation Commission (LAFCo) retroactively approved Out-of- <br /> Area Service Agreements (OASAs) allowing the City to continue to provide water and/or <br /> sewer services to 19 properties in the unincorporated Remen Tract at its July 13, 2017 <br /> meeting. Water and/or sewer services had been connected over the years to each of <br /> these 19 properties following the same procedures used for properties within the City's <br /> jurisdictional boundaries. But since the 19 properties are in the County of Alameda <br /> jurisdiction, the City should have requested that LAFCo approve an OASA for each <br /> property prior to allowing connection. When this omission was discovered, the City <br /> submitted an application to LAFCo for retroactive approval. The OASAs were <br /> retroactively approved, but as a condition of the approval, LAFCo is requiring the City to <br /> complete a comprehensive infrastructure study of the Remen Tract. The study is to <br /> include an inventory of the existing water and sewer utilities, and the determination of <br /> how to upgrade or extend those utilities to serve every property in the Remen Tract. The <br /> study is also to identify upgrades to this relatively rural area to bring the streets, sidewalks, <br /> lighting, etc. to City Standards. The study will include cost estimates of all identified <br /> improvements. LAFCo is requiring the study to understand all the costs associated with <br /> bringing the area to City standards before potential annexation. The City can use the <br /> study findings to determine how costs can be shared by those benefitting from the <br /> improvements. The current City Council direction is to consider applications for water <br /> and/or sewer services in the unincorporated Remen Tract area on a case-by-case basis. <br /> Staff is recommending the Council adopt an interim policy whereby no applications for <br /> services are considered until completion of the study and the potential cost sharing of the <br /> identified infrastructure is understood. <br /> RECOMMENDATION <br /> Adopt a resolution affirming an interim City policy to not accept applications for water <br /> and/or sewer services for properties within the Remen Tract until the completion of an <br /> infrastructure study for that area, and upon such time as the policy is rescinded by the <br /> Council. An exception would be provided for a health and safety emergency as <br /> determined by the Director of Community Development or City Engineer, LAFCo policies, <br /> and state law. <br />
