RESOLUTION NO. 17-964 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AUTHORIZING THE CITY ENGINEER TO EXECUTE TEMPORARY RIGHT OF ENTRY <br /> AGREEMENTS FOR CONSTRUCTION PROJECTS <br /> WHEREAS, the City regularly undertakes capital improvement projects and other <br /> scheduled and unexpected construction projects where City and City's contractors' personnel and <br /> equipment need to operate on private property adjacent to a construction site; and <br /> WHEREAS, in order to temporarily use private property for City construction projects, the <br /> City often enters into temporary right of entry agreements with such adjacent private property <br /> owners, and such agreements are standard templates with different provisions depending on the <br /> scope of entry; and <br /> WHEREAS, while the Municipal Code authorizes the City Manager to execute such <br /> documents as part of his regular powers and duties (see §2.08.070), construction project time <br /> constraints and in-the-field meetings would be more efficient if the City Engineer were also <br /> authorized to enter into such temporary right of entry agreements on behalf of the City. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. The City Council authorizes the City Engineer to execute on behalf of the <br /> City temporary right of entry agreements to allow City and City's contractors' personnel and <br /> equipment to enter onto private property for City construction projects. <br /> SECTION 2.
