Commissioner Balch: Do they require a permit over a certain height? <br />Soo: They should come in for the permit and actually I saw it today. <br />Commissioner Balch: So if I build a structure of 121 square feet at my house without a <br />permit, typically that's a code enforcement issue, correct? <br />Soo: Correct. <br />Commissioner Balch: Has code enforcement issued a citation for that? You just told me <br />it required a permit. <br />Beaudin: Can I jump in here? The CUP process here is probably the appropriate way to <br />do that. So you can decide tonight if part of your action, if you choose to do so, to permit <br />those or to grant planning approval for those. And if you do, they would have to come in <br />and have to go through the building permit process. If you don't, then they would have <br />to remove those from the property. <br />Commissioner Balch: Okay, if I may, I've seen one or two of these actually in my time <br />despite my slight grey hair. So, typically when there's a structure without a permit they <br />can hold action on a code enforcement action so that they can go through approval. Do <br />you have a permit or application on file for a building and a design review request? <br />Soo: Not at this time. <br />Commissioner Balch: I don't see that attached to the staff report, so I see an item where <br />a permit is required, no code enforcement action or citation has occurred, and no <br />application is pending that would put a pause on City enforcement. <br />Beaudin: Code enforcement is completely complaint- driven. <br />Commissioner Nagler: I'm sorry Gerry, are they really permanent structures or are they <br />these temporary things that you can buy at Costco? <br />Beaudin: They're utility sheds and there are a number of them on the property. <br />Commissioner Nagler: But they're temporary things, right? I mean, I walked back there <br />and I thought they were. <br />Beaudin: The definition of temporary is that someone could come and remove these <br />things pretty quickly. This is not attached to the building in any way. These are true <br />accessory ... they're sheds on the property. There is no application. If we had a neighbor <br />complain and somebody said we think there's building without permits and these <br />structures need a permit, we'd go out and enforce. We've been there. This is one of the <br />challenges with where we are in the process. Staff resources are what they are. We <br />have one code enforcement officer in the City of Pleasanton. He responds to <br />complaints, and we've got this application moving through our process. We know that <br />there's a likely sale. It's in escrow, so we hope that within a month we have a new <br />PLANNING COMMISSION MINUTES, June 22, 2016 Page 12 of 56 <br />
