Commissioner O'Connor moved to: <br />1. find that the conditions described in California Environmental Quality Act <br />(CEQA) Guidelines Section 15162 have not occurred as described in the <br />Addendum to the Supplemental Environmental Impact Report (SEIR) and <br />that the previously prepared SEIR, including the adopted CEQA Findings <br />and Statement of Overriding Considerations, the Addendum to the SEIR, <br />and the memo to the Addendum are adequate to serve as the <br />environmental documentation for this project and satisfy all the <br />requirements of CEQA; <br />2. find that the proposed PUD Major Modification (P15 -0170) to amend City <br />Council Ordinance No. 2030 to modify the required minimum density of <br />30 dwelling units per acre to a density of 15.9 dwelling units per acre for <br />the project side and, the PUD Development Plan (PUD- 81- 30 -89D) for the <br />construction of a 94 -unit condominium development and related on -site <br />improvements, are consistent with the General Plan; <br />3. find that the proposed PID Major Modification (PUD- 81- 30 -55M) to modify <br />the Housing Site Development Standards and Design Guidelines to modify <br />the minimum and maximum density from 30 dwelling units per acre for the <br />project site to a density of 15.9 dwelling units per acre is consistent with <br />the General Plan; <br />4. find that the proposed amendment to the Development Agreement <br />(P15 -0169) is consistent with the General Plan; <br />5. make the PUD findings for the proposed Development <br />Plan (PUD -81 -30 -89D) as listed in the staff report; <br />6. find that the exceptions to the Housing Site Development Standards and <br />Design Guidelines, as listed in the staff report, are appropriate; and <br />7. recommend approval of Cases P15 -0170 (PUD Major Modification to amend <br />City Council Ordinance No. 2030), PUD -81 -30 -89D (PUD Development Plan), <br />PUD -81 -30 -55M (Major Modification to modify the Housing Site <br />Development Standards and Design Guidelines), and P15 -0169 <br />(amendment to the Development Agreement) to the City Council. <br />Commissioner Piper seconded the motion. <br />ROLL CALL VOTE: <br />AYES: Commissioners Allen, Nagler, O'Connor, and Piper. <br />NOES: None <br />ABSTAIN: None <br />RECUSED: Commissioner Balch <br />ABSENT: Commissioner Ritter <br />Resolution No. PC- 2015 -09 recommending approval of Case P15 -0170 (PUD Major <br />Modification to amend City Council Ordinance No. 2030), Resolution No. PC- 2015 -10 <br />recommending approval of Case PUD -81 -30 -89D (PUD Development Plan), Resolution <br />No. PC- 2015 -11 recommending approval of Case PUD -81 -30 -55M (Major Modification <br />PLANNING COMMISSION MINUTES, May 13, 2015 Page 29 of 32 <br />
