Mr. Dolan stated that he understands the discretion given to staff would be to have <br />furniture of a semi - permanent nature that could be moved, but they are not going to be <br />light aluminum chairs. <br />Commissioner Balch stated that if the furniture gets stolen anytime in the future <br />50 years from now, someone will have to pay for them to be put back. He indicated that <br />he is open to saying that could be worked out and could move forward personally; <br />however, that is his hiccup, and the condition could be only for the initial seating. <br />Mr. Dolan stated that he thinks, as a practical matter, that if the furniture were stolen, <br />staff would probably want to revisit the issue within his discretion, or bring it back to the <br />Planning Commission. <br />Commissioner Balch stated that he was fine with having the Director of Community <br />Development work it out; he just does not personally want a condition that makes it the <br />owner's responsibility. <br />Commissioner Ritter stated that everything always could come back to the Planning <br />Commission. <br />Commissioner Allen stated that she is fine with staff working it out. She added that <br />personally, she does not agree with Commissioner Balch's position and is on the <br />opposite end. She indicated that she would not want a condition that says it is not the <br />owner's responsibility because the City is giving the owner an amenity to that by waiving <br />the in -lieu parking fee. She added that she is fine with having staff work with the <br />applicant on the design parameters and what would happen if that design does not work <br />or if the furniture are stolen so that it is a win /win situation for both the applicant and the <br />City. <br />Mr. Sherwood commented that he would not want a plaza sitting there with no furniture <br />and that he would be willing to replace them if they were stolen or if they have marks on <br />them as he wants the plaza to look good. <br />Chair O'Connor commented that the applicant could work with staff to redesign the <br />furniture should they be stolen twice within several months. <br />ROLL CALL VOTE: <br />AYES: Commissioners Allen, Balch, O'Connor, Piper, and Ritter <br />NOES: None <br />ABSTAIN: None <br />RECUSED: None <br />ABSENT: None <br />Resolution No. PC- 2014 -26 approving Case P14 -0029 was entered and adopted as <br />motioned. <br />PLANNING COMMISSION MINUTES, May 28, 2014 Page 12 of 16 <br />
