pick -up of any cottage food being purchased from the premises, and for those with no <br />garages, staff is proposing loading hours of 8:00 a.m. to 6:00 p.m. Monday through <br />Friday, and 10:00 a.m. to 4:00 p.m. on weekends. <br />Ms. Amos continued that the noise requirement would be consistent with what is <br />already in place per the Municipal Code. She stated that the size of the facility would be <br />based on the lesser of two options: 30 percent of the floor area of the dwelling unit <br />excluding the garage area, or the area permitted by Alameda County Environmental <br />Health Food and Safety Division. She added that the terms of occupancy would be <br />what are required by the Building Code, and any internal changes, such as moving <br />walls, would require a building permit. She indicated that staff is also proposing to <br />prohibit signage, outdoor sales, and dining at the facility. <br />Acting Chair Blank inquired how realistic the no dining proposal is in terms of someone <br />coming in and asking to sample the goods. He added that he thinks the intent is great <br />but that it will be very difficult to implement. He noted that it could be more elegantly <br />worded, unless there is a formal definition somewhere in the text. <br />Ms. Amos replied that samples are allowed; what are specifically prohibited are <br />cafe -type settings. <br />With respect to loading of food products, Commissioner Narum noted that some of <br />these cottage food industries are similar to those at the farmers' market and would need <br />to be there to unload by 8:30 a.m. She inquired if the loading requirements and <br />allowable hours are realistic, given that some may not wish to be loading the night <br />before and risk having someone break into their cars to steal the cottage products, <br />versus loading in the morning. <br />Acting Chair Blank noted that this requirement is for those loading outside the garage <br />and that loading in the garage is allowed any time. He added that he would not support <br />changing that because people in the house next -door may not want loading to take <br />place early in the morning. <br />THE PUBLIC HEARING WAS OPENED. <br />There were no public speakers. <br />THE PUBLIC HEARING WAS CLOSED. <br />Commissioner Olson moved to recommend approval to the City Council of <br />Case P12 -1753 as proposed in Exhibit A of the staff report. <br />Commissioner Narum seconded the motion. <br />PLANNING COMMISSION MINUTES, November 28, 2012 Page 36 of 38 <br />
