He continued that the applicant is required to <br />submit a LiveScan finger - printing and a background check, and as long as the applicant <br />has not been involved in certain crimes such as possession of stolen property or theft, <br />the DOJ would issue a license and mail it to the PD, who would then give the license to <br />the applicant. He added that the PD does not do any type of investigation or any sort of <br />checks on how the businesses are run in other jurisdictions, and it does not have the <br />authority to deny the issuance of the license, which lies solely with the DOJ. <br />Commissioner Olson inquired if there were any problems, they would have shown up at <br />the DOJ. <br />Sgt. Schlehuber said yes, but only if there had been an arrest and a conviction. He <br />noted that the current process would not uncover any issues or problems in another <br />jurisdiction that did not rise to that level. <br />Chair Pentin requested clarification that each license is for each jurisdiction or for each <br />area only, and is not a blanket license for operating in any location. <br />Sgt. Schlehuber replied that was correct; the license is specific to a location <br />Commissioner Narum noted that several jewelry stores on Main Street advertise that <br />they buy gold. She inquired if these stores are required to have a license. <br />Sgt. Schlehuber said yes. He noted that this is a new business model that began a <br />couple of years ago and became pretty lucrative with the price of gold being what it is, <br />and a lot of the jewelry stores have gotten into it. He stated that the PD has <br />encountered some stores that started doing this business but were not in compliance <br />with the law, so Detective Keith Batt, who currently handles this portion of enforcement <br />and issuing the license, has gone to some of the stores and inquired whether or not <br />they have obtained a license and has brought them in compliance. He added, however, <br />that the PD has not put in the effort to check whether every store in the City is in <br />compliance, but PD will start putting this process in place, starting with an informational <br />campaign to let stores know that they are required to obtain these licenses and then <br />helping the business obtain the license. He noted that once these stores are in <br />compliance, the PD would work on any enforcement issues that might come up. <br />Chair Pentin inquired if the appellant is also in the same business and if he runs a local <br />business. <br />Ms. Stern replied that it is her understanding that the appellant does have the same <br />business in town. <br />THE PUBLIC HEARING WAS OPENED. <br />Ms. Rondash indicated that the appellant is not present. <br />PLANNING COMMISSION MINUTES, March 28, 2012 Page 3 of 33 <br />
