guilty of a misdemeanor and shall be punished as provided <br /> in Section 1-1.11 of Chapter 1, Title I of the Ordinance <br /> Code of the City of Pleasanton. <br /> <br /> ~4-8.06 Conflicts. The requirements of this chapter shall be <br /> <br />in addition to any other provisions of this code regulating <br />the consumption of alcoholic beverages. If this chapter is <br />in conflict with any presently existing article, chapter or <br />title, the existing provisions shall control. <br />Section 2. This ordinance shall become effective immediately upon its <br />introduction and adoption by a four-fifths vote of the City Council as <br />an urgency measure, as provided in Government Code Sections 36934 and <br />36937. <br /> <br />Section 3. The circumstances creating this urgency are: <br /> <br /> 1. A large number of individuals congregate in the commercial <br /> areas of the City, especially in the Central Business Dis- <br /> trict, on warm nights and drink alcoholic beverages in pub- <br /> lic. <br /> <br /> 2. The existence of public drinking encourages minors who con- <br /> gregate in the same areas to obtain alcoholic beverages from <br /> adults. <br /> <br /> 3.Public disturbances, excessive noise and litter are created <br /> <br /> by the drinking in public. <br /> <br /> 4. Businesses are unable to conduct their normal activities due <br /> to the reluctance of the public to come into an area where <br /> large numbers of adults and minors are congregating and <br /> drinking in public. <br /> <br /> 5. Police enforcement becomes difficult due to the large numbers <br /> of people and behavioral deterioration cal~ed by the drinking <br /> of alcoholic beverages in public. <br /> <br /> -4.- <br /> <br /> <br />
