CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 824 <br /> <br /> AN ORDINANCE ADDING CHAPTER 6 TO TITLE IV (HEALTH, <br /> SAFETY, MORALS & GENERAL WELFARE) OF THE ORDINANCE <br /> CODE OF THE CITY OF PLEASANTON RELATING TO DRINK- <br /> ING IN PUBLIC & ADOPTING THE SAME AS URGENCY MEASURE. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: <br />Section 1. Chapter 6 (Drinking in Public) is added to Title IV of <br />the Ordinance Code of the City of Pleasanton to read as follows: <br /> <br /> Chapter 6 <br /> <br /> Drinking in Public <br /> <br /> ~4-8.01 Drinking in or on Streets or Other Property. <br /> Except as otherwise provided in Section 4-8.02 it is <br /> unlawful for any person to partake of any spirituous, malt, <br /> vinous or alcoholic liquors or other alcoholic beverages in <br /> or on any street or sidewalk, or any passageway open to pub- <br /> lic use, or in or on any park, playground or community house, <br /> or on public property which is open and accessible to the <br /> general public, or on private property which has been <br /> approved for Commercial or Industrial uses (including park- <br /> ing areas) which is open and accessible to the general <br /> public. <br /> <br /> ~4-8.02 Exceptions. The provisions of Section 4-8.01 shall <br /> <br /> not be applicable to the following: <br /> <br /> a. During regular business hours, those portions of a <br /> commercial establishment, open and accessible to the <br /> public, upon which alcoholic beverages may be sold <br /> or consumed in accordance with a valid on sale license <br /> from the California Department of Alcoholic Beverage <br /> Control. <br /> <br /> <br />
