and sewer connections in the unincorporated Happy Valley area. The resolution is much <br /> the same as the policy that was put in place in 2002, with one additional but fairly <br /> significant requirement. The resolution gives the City Engineer the authority to use the <br /> water and sewer study prepared by RMC Engineering and presented to City Council on <br /> February 21, 2017 when determining how a property makes connection. This would mean <br /> that the case-by-case process could include as an additional condition of connection <br /> approval that the property owner construct a portion of the public infrastructure identified <br /> in the study, or be required to pay a pro-rata share of infrastructure already constructed <br /> by prior development. Note this condition could add significant expense to a requested <br /> connection. However this additional condition, like all conditions applied in the case-by- <br /> case process, would ultimately be decided by City Council when a pre-annexation <br /> agreement is presented for approval by Council as is necessary before application is <br /> made to LAFCo for annexation or an OSA. <br /> The reason the condition could add expense to a requested connection is the water and <br /> sewer study determined how to connect every property within the unincorporated Happy <br /> Valley area to a public water and sewer system that complies with Pleasanton Municipal <br /> Code. This generally means installation of water and sewer piping in the easements <br /> (roadways) that property owners use to access their properties. It is conceivable that <br /> some properties, when considered on a case-by-case basis, could find an alternative <br /> method to make utility connections. For example, they may work with a neighbor to obtain <br /> a private easement thereby creating shorter pipe run and less costly way to connect to <br /> an existing public water or sewer pipe. The private lateral in a private easement conforms <br /> with the municipal code, but allowing such a connection would not accomplish the goal of <br /> building components of the water and sewer systems identified in the study.
