THE CITY OF _ 2
CITY COUNCIL AGENDA REPORT
pLEASANTON.
July 18, 2017
City Attorney's Office
TITLE: ADOPT A RESOLUTION IMPOSING A SPECIAL ASSESSMENT ON 4719
ORANGEWOOD COURT, PLEASANTON (ASSESSOR'S PARCEL
NUMBER 941-1001-047-00) FOR THE COSTS OF ABATEMENT,
INCLUDING INSPECTION COSTS, INVESTIGATION COSTS, AND
ATTORNEY FEES, ALL INCURRED IN A NUISANCE ABATEMENT
ACTION ON THE PROPERTY
SUMMARY
As a result of the creation of a nuisance on the property at 4719 Orangewood Court,
owned by Thomas and Craig Spitzer, the City of Pleasanton has incurred significant
fees and costs including code enforcement and hazardous materials inspector
personnel fees as well as legal fees and costs associated with the receivership action in
state court. The City can endeavor to recover the costs of the nuisance abatement by
imposing a special assessment against the parcel.
RECOMMENDATION
Staff recommends that the City Council adopt a resolution to impose a special
assessment in the amount up to $141,231.39 for the attorney fees, investigation costs,
prosecution costs, and enforcement costs, all incurred in abating a nuisance on 4719
Orangewood Court.
FINANCIAL STATEMENT
Although the fees and costs do not compensate the City for all of its staff time and
resources spent addressing the nuisances at 4719 Orangewood Court, at least a
portion would be reimbursed.
