THE CITY OF _ 2 <br /> CITY COUNCIL AGENDA REPORT <br /> pLEASANTON. <br /> July 18, 2017 <br /> City Attorney's Office <br /> TITLE: ADOPT A RESOLUTION IMPOSING A SPECIAL ASSESSMENT ON 4719 <br /> ORANGEWOOD COURT, PLEASANTON (ASSESSOR'S PARCEL <br /> NUMBER 941-1001-047-00) FOR THE COSTS OF ABATEMENT, <br /> INCLUDING INSPECTION COSTS, INVESTIGATION COSTS, AND <br /> ATTORNEY FEES, ALL INCURRED IN A NUISANCE ABATEMENT <br /> ACTION ON THE PROPERTY <br /> SUMMARY <br /> As a result of the creation of a nuisance on the property at 4719 Orangewood Court, <br /> owned by Thomas and Craig Spitzer, the City of Pleasanton has incurred significant <br /> fees and costs including code enforcement and hazardous materials inspector <br /> personnel fees as well as legal fees and costs associated with the receivership action in <br /> state court. The City can endeavor to recover the costs of the nuisance abatement by <br /> imposing a special assessment against the parcel. <br /> RECOMMENDATION <br /> Staff recommends that the City Council adopt a resolution to impose a special <br /> assessment in the amount up to $141,231.39 for the attorney fees, investigation costs, <br /> prosecution costs, and enforcement costs, all incurred in abating a nuisance on 4719 <br /> Orangewood Court. <br /> FINANCIAL STATEMENT <br /> Although the fees and costs do not compensate the City for all of its staff time and <br /> resources spent addressing the nuisances at 4719 Orangewood Court, at least a <br /> portion would be reimbursed. <br />
