go into effect for new leases, and for existing leases that renew after Feb. 18, 2018. For
current leases that renew before Feb. 18, 2018, landlords would have the option of giving
current tenants who smoke additional time to remain on-site and continue to allow
smoking for one additional year. For example, a lease that allows smoking that expires
on Jan. 31, 2018 could be renewed for one more year on the same terms through January
31, 2019. Of course, in that same example, the landlord could also choose to renew the
lease on January 31, 2018 for an additional year, but change the terms and have the
smoking restrictions in effect as of Feb. 18, 2018.
The proposed ordinance does also have this six month deadline of Feb. 18, 2018 for
signage and lease disclosures. There is no deadline for an owner to decide whether or
not to provide an outdoor area where smoking is permitted.
If the proposed ordinance is adopted, information will be provided to owners and
managers of multifamily rental projects to explain the smoking prohibitions, voluntary
option for establishing an outdoor smoking area, signage requirements, lease disclosure
provisions, enforcement, and timing for implementation. Along with this information will
also be provided referrals for smoking cessation resources, as that is an interest of the
Housing Commission based on offers for assistance provided by the Alameda County
Tobacco Control Coalition of the Alameda County Department of Public Health. The
proposed six month period until the ordinance takes effect, plus accommodation for
existing leases being renewed, provides sufficient time for owners and managers to
implement new procedures, allows existing residents to make housing choices, and
meets public health policy goals.
Submitted by: Fis /Review: Approved by:
- eto5SA (LAi /Lit/
Larissa Seto Tina Olson Nelson Fialho
Assistant City Attorney Director of Finance City Manager
Attachments:
1.
