THE CITY OFI, 8 <br /> fin' '�a'. 1 <br /> PLEASANTON CITY COUNCIL AGENDA REPORT <br /> June 20, 2017 <br /> City Attorney <br /> TITLE: CONSIDER INTRODUCTION OF AN ORDINANCE TO ADD TO THE <br /> PLEASANTON MUNICIPAL CODE A NEW CHAPTER 9.26 <br /> RESTRICTIONS ON SMOKING IN MULTIFAMILY RENTAL APARTMENTS <br /> AND A UNIFYING AMENDMENT TO §9.24.060 <br /> SUMMARY <br /> A current Council Priority is consideration of smoking restrictions in multifamily rental <br /> apartments. The policy interest is health concerns from secondhand smoke exposure. <br /> The proposed ordinance would prohibit smoking inside of apartments, on balconies and <br /> patios, within indoor and outdoor common areas, and also within 25 feet of these areas. <br /> To accommodate smokers, apartment owners could voluntarily choose to establish an <br /> outdoor smoking area at least 25 feet from these no smoking areas. The proposed <br /> ordinance also requires owners to install signage and provide lease disclosures. <br /> Enforcement would first be by owners and managers, and potential citation only <br /> thereafter. Provisions generally would take effect in six months, with potential later <br /> effective dates for existing leases being renewed. The Housing Commission and a strong <br /> majority of apartment owners and managers support these smoking restrictions. <br /> HOUSING COMMISSION RECOMMENDATION <br /> That the Council adopt restrictions on smoking inside of multifamily rental apartments, <br /> balconies, patios and common areas; to go into effect six months after adoption. <br /> RECOMMENDATION <br /> That the Council introduce an ordinance to add to the Pleasanton Municipal Code a new <br /> Chapter 9.26 Restrictions on Smoking in Multifamily Rental Apartments, with unifying <br /> amendment to §9.24.060 (Attachment 1). <br /> FINANCIAL STATEMENT <br /> Existing staff in the City Attorney's Office and Housing Division are anticipated to be able <br /> to educate multifamily rental apartment owners and managers about these new <br /> restrictions on smoking. The City's Code Enforcement Officer and Police Department <br /> staff are also expected to add this to existing enforcement duties on a complaint-made <br /> basis, after the apartment owner or manager demonstrate that they have diligently <br /> pursued compliance as required by the proposed ordinance. <br />
