CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 03-105 <br /> <br />RESOLUTION REAFFIRMING CITY COUNCIL'S PRIOR DECISION <br />APPROVING VESTING TENTATIVE TRACT MAP - TRACT 7399, <br />NORTHSTAR CONSTRUCTION AND DEVELOPMENT <br /> <br />WHEREAS, <br /> <br />at its meeting of July 9, 2003, the Planning Commission denied Vesting Tentative <br />Map 7399, the application of Northstar Construction and Development consisting <br />of: (1) 19 single-family lots within the 13.2-acre Low Density area; (2) a 12.4- <br />acre Hillside Residential/Open Space lot (Parcel A) containing the existing <br />Chrisman residence and associated accessory buildings; (3) three commonly- <br />owned open space lots (Parcels B, C and D) containing about 4.7 acres located at <br />1944 Vineyard Avenue (Lot 23 in the Vineyard Avenue Corridor Specific Plan) <br />and a portion of 2200 Vineyard Avenue (Lot 22); and <br /> <br />WHEREAS, the property is zoned Planned Unit Development - Low Density <br /> Residential/Hillside Residential/Open District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Northstar <br /> Construction and Development submitted an appeal; and <br /> <br />WHEREAS, a duly noticed public heating was held on August 19, 2003 at which time the <br /> public was given the oppommity to comment on the proposed project; and <br /> <br />WHEREAS, the City Council found that there were no new or changed circumstances which <br /> required additional CEQA review of the project; and <br /> <br />WHEREAS, <br /> <br />the City Council found that Vesting Tentative Tract Map 7399 was consistent with <br />the fmdings presented in the Planning Commission staff report dated June 11, <br />2003, and was in conformance with the Vineyard Corridor Specific Plan and the <br />PUD development plan approved for this property; and <br /> <br />WHEREAS, on August 19, 2003, City Council upheld the appeal of Northstar Construction and <br /> Development and thereby approved Vesting Tentative Map 7399; and <br /> <br />WHEREAS, on September 2, 2003 City Council voted to reconsider its decision to approve <br /> Vesting Tentative Map 7399; and <br /> <br /> <br />
