Councilmember Pentin stated he wants to ensure that Valley Trails will have the opportunity to use the clubhouse once a month, for three hours. Councilmember Brown questioned the use of the busiest public restroom in the City to develop costs for the subject restroom. Mr. Weinstein reported that staff wanted to be conservative in estimating the cost and there is not a huge difference in the operations and maintenance costs with other restrooms in the City. He added there are limited effects relative to use. Councilmember Brown noted the developer will be gifting the City a tot lot, but asked regarding related costs. Mr. Weinstein stated the costs for the restrooms were the major concern as it is the highest cost, and became a priority for the developer to cover. Councilmember Brown stated there could be maintenance and repair expenses related to the on- going operation of the tot lot. Gerry Beaudin, Director of Community Development, stated the tot lot is mentioned in the Parks and Recreation Master Plan as a desirable component in the Valley Trails Park as well as the proposed landscape upgrades. Councilmember Brown reported hearing concerns about similar public restrooms and asked regarding the possibility of limiting access. Mr. Beaudin reported it would be possible to monitor and lock restrooms at appropriate times; access could be restricted electronically. Councilmember Narum referenced the Planning Commission minutes and comments regarding restroom access for servicing and for Police checks and asked whether any changes were made in response to those comments. Mr. Weinstein reported a Condition of Approval was added to the project that would ensure adequate access to and surveillance of the restroom. In further response to Councilmember Narum's questions, Mr. Weinstein reported there are no traffic impacts in relation to this project and addressed processes for requiring one in the future, if needed. Mayor Thorne referenced a letter from the school district and asked whether it had given up on the property. Nelson Fialho, City Manager, reported the school district entered into an agreement with the developer to mitigate school impacts. The language in the agreement acknowledges that mitigation has been achieved and that they are in support of the project moving forward. By signing the agreement, the Board's policy has been to pass on the site. Mayor Thorne stated he understood that the rule of not installing restrooms in neighborhood parks is more of a precedent, other than a policy. Mr. Weinstein reported there is a policy in the Parks Master Plan that specifically states restrooms will not be encouraged in neighborhood parks. He added it is also a policy of the City that is subject to change based on a vote of the City Council. It is ultimately, Council prerogative to decide on whether it is necessary. Mayor Thorne noted the policy will need to be reviewed by Council, at some point. Staff reported this has been designated as a neighborhood park since 1996. Mayor Thorne opened the public hearing. Jeff Schroeder, Ponderosa Homes, thanked staff for their help and neighbors who have supported the project. He reported agreeing to fund some of the maintenance of the public restroom and noted this not only completes the neighborhood, but the prior owners, the existing church, will put money back into the community. He addressed the agreement with the school district and made himself available to the school district and is willing to help them with the process of finding another site for their purposes.
