Vice Mayor Pentin noted that, in terms of mass transit and having a fifteen-minute headway, <br /> ADUs do not count towards the City's Transit Network Components (TNC). Mr. Weinstein <br /> responded affirmatively, stated that follows State rules and noted that mass transit is government- <br /> run. <br /> Mr. Beaudin reported the State does not define "transit" in their legislation and staff used the <br /> City's General Plan in its definition of "transit", extracted the services provided and drafted an <br /> appropriate definition for "transit" to facilitate parking relief that come with ADUs. Staff also <br /> considered Santa Rita and the City's connection with Livermore as to TNCs. He added that "ride <br /> sharing" would relieve a lot of pressure. <br /> In response to Vice Mayor Pentin's question, Mr. Beaudin reported that City must submit a final <br /> code to the State for its approval. Basing the definition of"transit" on the General Plan is rational. <br /> Vice Mayor Pentin opened the public hearing. <br /> Angelina Summers reported there is an ADU being built in her neighborhood but she was not <br /> made aware of it because she lives within 300 feet of the project. She opined the neighborhood <br /> should decide whether they want these units in their area. Additionally, she reported that water is <br /> running in the ladies' restroom. <br /> Vice Mayor Pentin closed the public hearing. <br /> MOTION: It was m/s by Brown/Olson to introduce and waive first reading of Ordinance No. 2161 <br /> amending the Municipal Code to comply with State legislation for assessor (second) dwelling <br /> units. <br /> Councilmember Narum offered a friendly amendment to direct staff to return to the City Council <br /> and the Planning Commission within a year, with a summary of the status of ADUs relative to <br /> transit areas and whether there are any issues of concern. <br /> Councilmembers Brown and Olson agreed to accept the amendment. <br /> In response to Councilmember Brown's request Mr. Weinstein explained the current notification <br /> process according to the type of ADUs or JADUs. <br /> Mr. Beaudin asked whether City Council would accept the summary to be presented along with <br /> the City's annual housing report. Members of Council agreed with.the request. Councilmember <br /> Narum stressed the need for the Planning Commission to review the summary as well. <br /> Councilmember Brown asked that the summary be presented in a manner that would be clearly <br /> understood by the layperson. <br /> Discussion followed regarding the City's notification practices. <br /> Motion passed by the following vote: <br /> Ayes: Councilmembers Brown, Narum, Olson, Vice Mayor Pentin <br /> Noes: None <br /> Absent: Mayor Thorne <br /> City Council Minutes Page 5 of 8 April 18,2017 <br />
