RESOLUTION NO. 17-933 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> APPROVING THE AFFORDABLE HOUSING AGREEMENT BETWEEN THE CITY OF <br /> PLEASANTON AND PONDEROSA HOMES II, INC., AS FILED UNDER CASE NO. <br /> PUD-113 <br /> WHEREAS, Pleasanton Municipal Code Chapter 17.40 (adopted by Ordinance No. <br /> 1488) sets forth a Lower Income Housing Fee requirement to support an affordable housing <br /> program which authorizes the City to enter into regulatory agreements with developers to <br /> exempt projects from the lower-income housing fee if a project provides fifteen percent <br /> (15%) of its residential units at affordable levels; and <br /> WHEREAS, Ponderosa Homes II, Inc., has made an application to the City for an <br /> Affordable Housing Agreement for the construction of 36 single-family homes located at <br /> 6900 Valley Trails Drive, filed under PUD-113; and <br /> WHEREAS, the Pleasanton Housing Commission at its meeting of November 17, <br /> 2016, reviewed and recommended approval of the Affordable Housing Agreement; and <br /> WHEREAS, a duly noticed public hearing was held by the City Council on May 2, <br /> 2017, at which time the public was given the opportunity to comment on the Affordable <br /> Housing Agreement; and <br /> WHEREAS, the City Council considered all the information presented at the public <br /> hearing regarding the terms of the Affordable Housing Agreement. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1. Finds that the proposed Affordable Housing Agreement between the <br /> City of Pleasanton and Ponderosa Homes II, Inc., is consistent with the City's General Plan <br /> and the objectives of the Lower-Income Housing Fee Ordinance and the City's affordable <br /> housing polices. <br /> SECTION 2. Approves the Affordable Housing Agreement between the City of <br /> Pleasanton and Ponderosa Homes II, Inc., a copy of which is attached hereto as Exhibit <br /> A and incorporated herein by this reference; and authorizes the City Manager to execute <br /> the Affordable Housing Agreement in generally the form attached as Exhibit A. <br /> SECTION 3. This resolution shall become effective immediately upon the effective <br /> date of the ordinance approving the PUD development plan and development agreement <br /> amendment for this project. <br /> 1 <br />
