The discharge of waste from the proposed subdivision would not result in violation <br /> of existing requirements prescribed by the California Regional Water Quality <br /> Control Board (RWQCB). <br /> No violation currently exists and sewer capacity is available for this subdivision. The <br /> project would not discharge any waste other than domestic sewage and all sewage would <br /> be discharged into the City's sanitary sewer system for ultimate treatment. Urban <br /> stormwater runoff is required to meet the City's RWQCB permit requirements for urban <br /> development. <br /> PUBLIC NOTICE <br /> Notices for this hearing were sent to surrounding property owners and tenants within a <br /> 1,000-foot radius of the site in addition to the entire Valley Trails Neighborhood. Staff has <br /> provided the location and noticing maps as Exhibit J for reference. At the time this report was <br /> published, staff has not received public comments as a result of this hearing's notification. Staff <br /> has included public comments received prior to and since the workshop as Exhibit K. <br /> ENVIRONMENTAL ASSESSMENT <br /> A draft Initial Study/Negative Declaration has been prepared for the proposed project. Based on <br /> the Initial Study, the proposed development would not have any adverse effects on the <br /> environment. Therefore, staff believes that the Negative Declaration can be issued in <br /> conformance with the California Environmental Quality Act (CEQA) Guidelines, pursuant to <br /> Section 15063. If the Planning Commission finds that the project would not have a significant <br /> effect on the environment, it must adopt a resolution recommending approval of the attached <br /> draft Negative Declaration. The Negative Declaration will be forwarded to the City Council as <br /> part of the staff report, along with any public comments received on the Negative Declaration, <br /> consistent with the State CEQA Guidelines. Staff has included the draft Negative Declaration as <br /> Exhibit L for the Commission's consideration. <br /> SUMMARY/CONCLUSION <br /> Staff closely worked with the applicant on the proposed development and appreciates the <br /> applicant's cooperation in revising the proposal to address comments from the Planning <br /> Commission and staff concerning site layout, the clubhouse, the tot lot and landscape <br /> improvements within Valley Trails Park, and other elements of the project.
