URGENCY ORDINANCE NO. 2159 <br /> AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON REAUTHORIZING THE PUBLIC, EDUCATIONAL AND <br /> GOVERNMENTAL ACCESS FEE IN MUNICIPAL CODE §6.54.060 <br /> WHEREAS, California Public Utilities Code § '5870(n), which was enacted by the <br /> State's Digital Infrastructure and Video Competition Act of 2006, authorized local <br /> agencies to adopt an ordinance establishing a fee on state-franchised video service <br /> providers to support public, educational, and governmental (PEG) access channel <br /> facilities; and <br /> WHEREAS, in 2010, the Pleasanton City Council adopted Ordinance No. 2013, <br /> which included Pleasanton Municipal Code §6.54.060 (Educational and governmental <br /> access:channel fee) to establish such a PEG fee; and <br /> WHEREAS, California Public Utilities Code § 5870(n) states that such an <br /> ordinance shall expire, and may be reauthorized, upon the expiration of a state franchise; <br /> and <br /> WHEREAS, California Video Franchise Certificate Franchise No. 0002 granted to <br /> Pacific Bell Telephone Co., doing business as SBC Pacific Bell Telephone Co., and doing <br /> .business as AT&T California, will expire on March 30, 2017; and <br /> WHEREAS, an urgency ordinance is needed to address public safety concerns of <br /> Pleasanton residents, visitors and businesses by ensuring that the PEG channel facilities <br /> of Tri-Valley Television (TV 30) remain available and funded through PEG fees so that <br /> critical local information, including Pleasanton-specific emergency warnings, can be <br /> timely.disseminated. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. The City of Pleasanton hereby reauthorizes the fee on state-franchised <br /> video service providers to support public, educational, and governmental channel facilities <br /> adopted in Ordinance 2013, and specifically Pleasanton Municipal Code §6.54.060. The <br /> fee shall remain unchanged and in full effect as to all state-franchised video service <br /> providers. <br />
