ORDINANCE NO. 2160 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> REAUTHORIZING THE PUBLIC, EDUCATIONAL AND GOVERNMENTAL ACCESS <br /> FEE IN MUNICIPAL CODE§6.54.060 ON STATE CABLE FRANCHISEES OPERATING <br /> WITHIN THE CITY OF PLEASANTON <br /> WHEREAS, California Public Utilities Code § 5870(n), which was enacted by the State's <br /> Digital Infrastructure and Video Competition Act of 2006, authorized local agencies to adopt an <br /> ordinance establishing a fee on state-franchised video service providers to support public, <br /> educational, and governmental (PEG) access channel facilities; and <br /> WHEREAS, in 2010, the Pleasanton City Council adopted Ordinance No. 2013, which <br /> included Pleasanton Municipal Code §6.54.060 (Educational and governmental access channel <br /> fee) to establish such a PEG fee; and <br /> WHEREAS, California Public Utilities Code § 5870(n) states that such an ordinance shall <br /> expire, and may be reauthorized, upon the expiration of a state franchise; and <br /> WHEREAS, California Video Franchise Certificate Franchise No. 0002 granted to Pacific <br /> Bell Telephone Co., doing business as SBC Pacific Bell Telephone Co., and doing business as <br /> AT&T California, will expire on March 30, 2017. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. The City of Pleasanton hereby reauthorizes the fee on state-franchised <br /> video service providers to support public, educational, and governmental channel facilities <br /> adopted in Ordinance 2013, and specifically Pleasanton Municipal Code §6.54.060. The fee shall <br /> remain unchanged and in full effect as to all state-franchised video service providers. <br /> SECTION 2. A summary of this ordinance shall be published once within fifteen (15) <br /> days after its adoption in "The Valley Times", a newspaper of general circulation published in the <br /> City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City <br /> Clerk's Office within fifteen (15) days after its adoption. <br /> SECTION 3. This ordinance shall be effective thirty (30) days after its passage and <br /> adoption. <br /> The foregoing ordinance was introduced at a regular meeting of the City Council of the <br /> City of Pleasanton on March 21, 2017 by the following vote: <br /> Ayes: Councilmembers Brown, Narum, Olson, Mayor Thorne <br /> Noes: None <br /> Absent: Councilmember Pentin <br /> Abstain: None <br />
