CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE N0. 814 <br /> <br /> AN ORDINANCE AMENDING SECTION 2-5.04 OF ARTICLE 1 <br /> (GENERAL), CHAPTER 2 (ZONING), TITLE II (ZONING <br /> AND DEVELOPMENT) OF THE ORDINANCE CODE OF THE CITY <br /> OF PLEASANTON RELATING TO THE APPLICATION OF THE <br /> PLEASANTON ZONING <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: <br />Section 1. Section 2-5.04 (Application), Article 1 (General), <br />Chapter 2 ~oning), Title II (Zoning and Development) of the Or- <br />dinance Code of the City of Pleasanton is hereby amended in its <br />entirety to read as follows: <br /> <br /> S2-5.04 Application. This chapter shall apply to all prop- <br /> erty owned by private persons, firms, corporations, or <br /> organizations except public streets and alleys. It shall <br /> also apply to property owned by the City of Pleasanton; <br /> by any agencies of the City of Pleasanton; or by any lo- <br /> cal agency required to comply with this chapter by State <br /> law. However, this chapter shall not apply to property <br /> owned by the United States of America or any of its <br /> agencies; by the State of California or any of its agen- <br /> cies or political subdivisions not required by Government <br /> Code S53090, et seq., to comply with the City's Zoning <br /> Chapter; or by any city (other than the City of Pleasanton , <br /> county or rapid transit district. All exempted agencies <br /> are urged to submit their proposed projects to the permit <br /> and review procedures set forth in this chapter and to <br /> cooperate in meeting the goals and objectives of this <br /> code and the Pleasanton General Plan. <br /> <br /> This chapter shall apply to structures and signs extend- <br /> ing into or above streets or alleys, to railroad rights- <br /> of-way, to electric and communications distribution and <br /> service wires where prescribed in the district regulations <br /> provided, however, that the routes or proposed electric or <br /> gas transmission lines shall be submitted to the Planning <br /> Commission for approval prior to the acquisition of right- <br /> of-way thereof. Upon review of the utility company's <br /> application and the Planning Director's proposed condi- <br /> tions for route approval, the Planning Commission may set <br /> a public hearing for purposes of considering alternate <br /> routes, or modifying any conditions vital to the public <br /> interest, which in the opinion of the Planning Commission <br /> requires a public hearing. <br /> <br /> Section 2. This ordinance shall become effective thirty (30) days <br /> after its passage and adoption. <br /> <br /> -1- <br /> <br /> <br />
