r <br /> E`'"0184I3 <br /> WHEREAS,- Developer Is agreeable to fulfilling the <br /> aforesaid conditions and wishes to defer improvement of that <br /> portion or Del Valle Parkway until deemed necessary by the <br /> City Engineer. <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED BETWEEN THE PARTIES <br /> HERETO AS FOLLOWS: - <br /> 1. Developer shall survey, plan, engineer, construct, <br /> and-finance street improvements along the Del Valle Parkway <br /> frontage of Developer's property from California Avenue to <br /> the westerly boundary on Lot 1 of Tentative Tract 4401. <br /> Street improvements to be constructed shall be those required ! <br /> by Condition No. 3 of Planning Commission Resolution No. 1837 <br /> and may include, but are not necessarily limited to, grading, <br /> curb and gutter, sidewalk, paving, street lighting, street <br /> trees, street monuments, underground utilities, storm <br /> drain facilities, sanitary sewer facilities, tree removal, and <br /> traffic control devices. Developer shall submit improvement <br /> plans for the aforesaid work to the City of Pleasanton for <br /> approval and shall enter into an improvement agreement for <br /> the work itself at the time of construction. <br /> 2. The work to be performed under this agreement shall <br /> • <br /> be commenced at such time in the future as is deemed necessary <br /> by the City Engineer. Upon notification that the work is <br /> necessary, Developer shall commence construction within a <br /> reasonable time thereafter and shell diligently pursue the <br /> work to completion. <br /> -2- <br /> • <br />
