CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 813 AN ORDINANCE AMENDING ARTICLE 14 (LICENSING REQUIREMENT AND REGULATIONS FOR MASSAGE ES- TABLISHMENTS ANDOUT-CALL MASSAGE SERVICE), CHAPTER 2 (SPECIAL PERMITS), TITLE IV (HEALTH, SAFETY, MORAL AND GENERAL WELFARE), OF THE ORDINANCE CODE OF THE CITY OF PLEASANTON RE- LATING TO OUT-CALL MASSAGE SERVICE AND DEFI- NITIONS THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: Section 1. Subsection (d)(Masseur), Section 4-2.1401 (Defini- tions), Article 14, Chapter 2, Title IV of the Ordinance Code of the City of Pleasanton is amended to read as follows: (d) "Massage Technician." Any person who engages in the practice of massage here- in defined. Section 2. Section 4-2.1402 (Permit Required), Article 14, Chap- ter 2, Title IV of the Ordinance Code of the City of Pleasanton is amended to read as follows: S4-2.1402 Permit Required. It shall be unlawful for any person to engage in, conduct or carry on, or to permit to be engaged in, conducted, or carried on, in or upon any premises in the City of Pleasanton, the operation of a massage establishment as herein defined, without first having obtained a permit from the Police Di- vision of the Public Safety Department pursu- ant to the provisions of this Chapter. No per- mit may be issued by the Police Division of the Department of Public Safety pursuant to the pro- visions of this Chapter for any person to en- gage in, conduct or carry on, or to permit to be engaged in, conducted, or carried on, in or upon any premises in the City of Pleasanton, an out-call massage service. Section 3. The following sections of Article 14, Chapter 2, Title IV of the Ordinance Code of the City of Pleasanton, are hereby amended by the deletion of language which in any manner relates to out-call massage services: S4-2.1403 (Filing and Fee Provision) ~4-2.1404 (Application for Massage Establishment Permit S4-2.1410 (Referral of Application to Other Departments ~4-2.1412 (Notice of Hearing) ~4-2.1413 (Issuance of Massage Establishment or Out- Call Massage Service Permit) S4-2.1415 (Masseur Permit Required)
