BACKGROUND <br /> The SFPUC purchased the Old Bernal Parcel along with 510 acres along Bernal Avenue <br /> (Bernal Property) together (Properties) in 1930 when they acquired Spring Valley Water <br /> Works. At that time, the Properties had approximately 100 wells that were used to pump <br /> ground water for sale outside of the Pleasanton area. Since 1949, the SFPUC has <br /> stopped pumping groundwater from the Properties' wells to be used outside of the <br /> Pleasanton area. Thus, the Bernal Property and Old Bernal Parcel have been surplus <br /> land to the SFPUC since 1949. The Properties were within Pleasanton's Planning Area <br /> and sphere of influence. In the early 1980s, the City began a comprehensive review of <br /> the City's General Plan. The result of this process, the 1986 Pleasanton Plan, designated <br /> the Properties as a "Specific Plan" that would allow for development of the site. Several <br /> planning efforts followed this designation that culminated in negotiations between the <br /> SFPUC, Greenbriar Homes, and the City to acquire the Bernal Property from the SFPUC <br /> to be developed for residential and commercial/office development and public open <br /> space. <br /> During negotiations with the SFPUC and Greenbriar Homes to acquire the Bernal <br /> Property from the SFPUC in 1999 and 2000, the City had included the Old Bernal Parcel <br /> in the deal. Unfortunately, when the contract for the Bernal Property was finalized, the <br /> Old Bernal Parcel was omitted. To avoid jeopardizing the Bernal Property deal, the City <br /> signed the contract without the Old Bernal Parcel. The City has tried at various times <br /> since 2000 to acquire the Old Bernal Parcel without success. The City's FY 2015/16 and <br /> 2016/17 Work Plan Priorities that was adopted by City Council identified acquiring the Old <br /> Bernal Parcel as a priority goal. <br /> The SFPUC formally placed the Old Bernal Parcel on the market in the fall of 2016. The <br /> City submitted the highest most responsive bid of $4.2 million which is the amount the <br /> SFPUC staff indicated was the minimum they would accept since it was consistent with <br /> an appraisal the SFPUC had completed on the Old Bernal Parcel in May of 2016. The <br /> SFPUC received another bid for $4.2 million but the financing of that bidder was less <br /> secure than the City of Pleasanton and the other terms were less favorable to the SFPUC. <br /> The City Council approved the Agreement on December 20, 2016 and the San Francisco <br /> Board of Supervisors approved the Agreement on February 28, 2017. The City made two <br /> deposits totaling $100,000 towards the $4.2 million purchase price leaving $4.1 million to <br /> be paid at the close of escrow. In addition, there are various closing costs totaling $30,000 <br /> that the City must pay to finalize the acquisition. According to the Agreement, the close <br /> of escrow will be on April 11, 2017. <br /> DISCUSSION <br /> The City's General Plan designation for the Old Bernal Parcel is currently "Public and <br /> Institution." The City is in the process of updating the City's Downtown Specific Plan that <br /> includes the Old Bernal Parcel. Thus, the exact future General Plan designation may <br /> change. City staff is aware that ACE train is interested in using the Old Bernal Parcel for <br /> Page 2 of 3 <br />
