1.24 "Mortgagee" means the holder of the beneficial interest under any Mortgage <br /> encumbering all or any portion of the Property or Developer' rights under this Agreement, and <br /> any successor, Assignee, or transferee of any such Mortgagee. <br /> 1.25 "Notice of Compliance" has the meaning set forth in Section 6.2. <br /> 1.26 "Notice of Intent to Terminate" has the meaning set forth in Section 7.2. <br /> 1.27 "Party" or"Parties" has the meaning set forth in the Preamble. <br /> 1.28 "Periodic Review" has the meaning set forth in Section 6.1. <br /> 1.29 "Permitted Assignees" has the meaning set forth in Section 9.1(a). <br /> 1.30 "Permitted Assignment" has the meaning set forth in Section 9.1(a). <br /> 1.31 "Planning Commission" means the Pleasanton Planning Commission. <br /> 1.32 "Project" has the meaning set forth in Recital C. <br /> 1.33 "Project Approvals" has the meaning set forth in Recital D and, as used herein, <br /> shall include all "Subsequent Approvals" as defined in Section 5.1(b) <br /> 134 "Property" has the meaning set forth in Recital B. <br /> 1.35 "Regulatory Processing Fees" has the meaning set forth in Section 4.1(b). <br /> 1.36 "Subsequent Approval"has the meaning set forth in Section 5.1(b). <br /> 1.37 "Subsequently Adopted Rules" has the meaning set forth in Section 5.1(c). <br /> 1.38 "Term" has the meaning set forth in Section 2.1. <br /> 1.39 "Vesting Tentative Map" has the meaning set forth in Recital D.6. <br /> 1.40 "Zoning Amendments" has the meaning set forth in Recital D.3. <br /> SECTION 2. TERM OF THIS AGREEMENT <br /> 2.1 Effective Date and Term of Agreement. <br /> This Agreement shall become effective upon the occurrence of both of the following: the <br /> Approving Ordinance becoming effective; and the ordinance adopting the Zoning Amendments <br /> becoming effective ("Effective Date"). <br /> 5 <br />
