ATTACHMENT I <br /> AGREEMENT <br /> BETWEEN THE CITY OF PLEASANTON AND <br /> DUBLIN SAN RAMON SERVICES DISTRICT <br /> REGARDING FUTURE <br /> REGIONAL WASTEWATER CAPACITY RESERVE FEE CREDITS <br /> This Agreement ("Agreement') is entered into and effective as of <br /> 2017 ("Effective Date") by and between Dublin San Ramon <br /> Services District ("DSRSD"), a public corporation, and the City of Pleasanton ("City"). <br /> DSRSD and the City of Pleasanton are collectively referred to herein as the "Parties." <br /> WHEREAS, DSRSD and the City of Pleasanton have granted various Advance <br /> Sale Sewer Permits and/or Regional Wastewater Capacity Reserve Fee Credits for <br /> sewer capacity in previous years, but the amount of these Credits to the Regional <br /> Wastewater Capacity Reserve Fee program is not easily discernible; and <br /> WHEREAS, certain Regional Wastewater Capacity Reserve Fee Credits have <br /> been recognized in a separate "Agreement Between the City of Pleasanton and Dublin <br /> San Ramon Services District Regarding City of Pleasanton Advance Sale Sewer <br /> Permits" in the amount of $1,240,150, and are identified in this Agreement as the "Lund <br /> Credits"; and <br /> WHEREAS, there is a potential that DSRSD may grant up to 70 Regional <br /> Wastewater Capacity Reserve Fee Credits, which will occur, if at all, no later than <br /> December 31, 2021 in the total amount of$1,053,430, and these credits are identified in <br /> this Agreement as the "Dublin Credits"; and <br /> WHEREAS, DSRSD and/or City may have granted various additional Advance <br /> Sale Sewer Permits and/or Regional Wastewater Capacity Reserve Fee Credits in the <br /> past which are not currently identified or known, and which have an unknown value, and <br /> these credits are identified in this Agreement as the "Unknown Credits"; and <br /> WHEREAS, the financial impact of the Regional Wastewater Capacity Reserve <br /> Fee Credits described above has not been reflected in the 2004 Regional Sewer <br /> Capacity Reserve Fee Study, nor the 2008 Regional Sewer Capacity Reserve Fee <br /> Study, nor the 2010 Regional Sewer Capacity Reserve Fee Study, and the revenue <br /> shortfall resulting from allowing these credits generally may not be reallocated from <br /> development occurring prior to 2016 to new development occurring after 2017; and <br /> WHEREAS, DSRSD intends to update the Regional Wastewater Capacity <br /> Reserve Fee in 2017 in close consultation with the City, and therein to account for all <br /> then known existing Regional Wastewater Capacity Reserve Fee Credits and Advance <br /> Sale Sewer Permits within the DSRSD service area and the City of Pleasanton, which <br /> consist of the Lund Credits and the Dublin Credits if any, and any Unknown Credits <br /> which may be identified prior to or during the Regional Wastewater Capacity Reserve <br /> Fee update process. <br /> 02 15 17 REMAINING REGIONAL CREDITS Page 1 of 6 <br />
